These Terms govern your use of the King of the Hill live song-rating experience at live.kylebeats.com (the “Service”), operated by Kyle Beats (“we”, “us”). By submitting a song, voting, purchasing, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who can use the Service

• You must be at least 13 years old to use the Service.
• You must be at least 18 (or the age of majority where you live) to make any purchase. If you are under 18, you may only use the free features.
• You are responsible for anything done through your submission or account.

2. Submitting music

When you submit a song — by link or by uploading a file — you confirm and agree that:

• You own or control all rights in the recording and the underlying composition, or you have permission from every rights holder to submit it.
• The submission does not infringe anyone’s copyright, trademark, publicity, privacy, or other rights, and contains no unlawful content.
• You grant us a non-exclusive, worldwide, royalty-free license to store, reproduce, publicly perform, stream, broadcast, and display your submission (in whole or in part) as part of the Service and any associated live stream, recording, clip, replay, or promotional material, on any platform (including YouTube, TikTok, Twitch, Instagram, and similar services), for as long as we keep that content available.
• You grant us the right to display the artist name, song title, artwork, and any message you submit alongside your song.
• You waive any claim to royalties, fees, or other payment for that use.

You keep ownership of your music. This license only lets us play and show it in connection with the Service.

Uploaded audio files are deleted when the session they were submitted to ends. Please keep your own copy — we are not a storage or backup service.

3. What a paid submission actually buys

Skip, Super Skip, and Throne are optional paid upgrades. They buy you a higher position in the queue — nothing more. Specifically:

• A paid submission is not a guarantee that your song will be played, reviewed, discussed, or reach the voting stage. Sessions end, run out of time, or stop for reasons outside anyone’s control.
• It is not a guarantee of any particular feedback, outcome, rating, or result, and does not guarantee you will win a round or receive any prize.
• It does not create any partnership, employment, management, publishing, or representation relationship between you and Kyle Beats.
• We may remove, skip, or refuse any submission at our discretion — including submissions that break these Terms, are unplayable, are private/region-locked, or that we consider inappropriate for a live broadcast.

4. Payments and refunds

• Payments are processed by Stripe. We never see or store your full card details. Your purchase is also subject to Stripe’s terms.
• Prices are shown in US dollars and are charged at the time of purchase. International cards are accepted; your bank may add conversion or foreign transaction fees.
• All sales are final. Because a paid position is delivered immediately and consumed within a live event, purchases are generally non-refundable.
• As a courtesy, we will normally refund you if a technical failure on our side meant your paid submission was never placed in the queue, or if the session was cancelled and your song was never reached. Contact us and we will look into it in good faith.
• Do not charge back a payment before contacting us. We will always try to sort it out first.

5. Voting

Voting is intended to be one vote per person per round. Attempting to manipulate the result — including automated voting, multiple devices or browsers, scripts, or coordinating vote brigading — is prohibited, and we may discard votes, remove songs, or block access at our discretion. Vote counts and results are final as determined by us.

6. Prize pools (only if one is offered)

Most sessions do not have a prize pool. There is no ongoing, recurring, or guaranteed prize of any kind, and nothing on the Service should be read as promising one. We may occasionally choose to offer a prize for a particular session, entirely at our discretion. If we do, it applies to that session alone and the following terms apply to it.

• Paying is never an entry fee for a prize. Skip, Super Skip, Throne, and the add-ons buy a position in the queue or a service described at checkout. They do not buy a prize, a chance to win, or an improved chance of winning anything.
• No purchase is necessary. You can submit a song for free and, where a prize is offered, be eligible on exactly the same basis as anyone who paid.
• Any figure shown is informational only — a display of an amount we may choose to award. It is not a promise, and no money is held in trust or escrow for you.
• Any payment is a discretionary gift paid manually by us after the session. It is not processed automatically and is not administered through the Service.
• Outcomes are determined by audience voting, not by chance. We may change, reduce, or cancel a prize, or withhold payment where we reasonably suspect fraud, vote manipulation, or a breach of these Terms.
• You are responsible for any taxes on amounts you receive. We may require your details (and tax forms where legally required) before paying anything.
• Where a prize would be unlawful or would require registration in your jurisdiction, it is void there.

7. Acceptable use

Do not use the Service to submit or transmit anything that is unlawful, infringing, hateful, harassing, threatening, sexually explicit, or that contains malware. Do not attempt to break, overload, scrape, reverse-engineer, or gain unauthorized access to the Service. Do not impersonate anyone else.

8. Live broadcast

The Service is used alongside live streams on third-party platforms. Your submission, artist name, message, and the audience’s reaction to it may be broadcast live and recorded, clipped, replayed, and shared publicly. Do not submit anything you are not comfortable being broadcast permanently and publicly. Those third-party platforms have their own terms and we do not control them.

9. Availability

The Service is provided “as is” and “as available”. Sessions may be delayed, cut short, rescheduled, or cancelled. Features may change or be withdrawn. We do not promise the Service will be uninterrupted or error-free.

10. Limitation of liability

To the fullest extent permitted by law, Kyle Beats and anyone working with us will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost opportunities, lost goodwill, or lost data, arising from your use of the Service. Our total liability to you for any claim is limited to the amount you paid us in the 30 days before the claim arose, or US$100, whichever is greater. Nothing here excludes liability that cannot legally be excluded.

11. Indemnity

You agree to indemnify and hold harmless Kyle Beats from any claim, demand, loss, or expense (including reasonable legal fees) arising from your submission, your breach of these Terms, or your infringement of anyone else’s rights — in particular any claim that music you submitted infringes a third party’s rights.

12. Copyright complaints

If you believe content on the Service infringes your copyright, contact us via the link below with details of the work, the material in question, and your contact information, and we will remove or disable it where appropriate. We may terminate access for repeat infringers.

13. Changes

We may update these Terms. The “last updated” date above will change, and continued use of the Service after that means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the United States and the State of Texas, without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts located in Texas, and you consent to that jurisdiction.
